DRIVER AGREEMENT
CMG Hotshot Transport LLC
This agreement is between CMG Hotshot Transport LLC and the undersigned driver.
1.Position
Driver is engaged as an Independent Contractor or Company Driver to operate commercial vehicles on behalf of the company.
2.Duties & Responsibilities
Driver agrees to operate safely, comply with FMCSA regulations, perform inspections, secure loads, deliver on time, maintain logs, and communicate with dispatch.
3.Compensation
Driver will be compensated based on agreed terms (percentage, per mile, or salary). Pay schedule is weekly or bi-weekly.
4.Deductions
Deductions may include fuel advances, tolls, damages due to negligence, insurance deductibles, and late delivery penalties.
5.Equipment Care
Driver must keep equipment clean, report issues, and avoid operating unsafe equipment.
6.Compliance
Driver must maintain valid licensing, follow HOS rules, and pass drug/alcohol screenings.
7.Insurance & Liability
Company provides liability insurance. Driver may be responsible for deductibles if at fault.
8.Termination
Either party may terminate with notice or immediately for violations such as safety issues or misconduct.
9.Escrow / Driver Holdback
After the first pay period, $125 will be deducted per pay period until $2,500 is reached. Funds are held in escrow for damages or liabilities. Funds will be returned upon separation if driver leaves in good standing and no balances exist.
10.Inspections & Performance Evaluation
Routine in-house inspections will be conducted. Drivers are evaluated quarterly based on safety, performance, communication, and compliance.
11.Bonus & Incentive Program
Drivers may receive bonuses for safety, performance, and long-term service. Bonuses are discretionary and based on company standards.
